Americans with Disabilities Act (ADA) and 504
Subtitle A of Title II of the Americans with Disabilities Act (ADA), Public Law 101-336, prohibits discrimination on the basis of disability by public entities. It protects qualified individuals with disabilities from discrimination in the services, programs, and activities of all state and local governments. Title II extends the protections established under Section 504 of the Rehabilitation Act of 1973 to all state and local government programs and activities, regardless of whether they receive federal financial assistance, and incorporates applicable provisions of Titles I, III, and V of the ADA.
Allegany County Public Schools (ACPS) is committed to ensuring equal access and opportunity for all individuals with disabilities. ACPS complies with the requirements of Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA), the Individuals with Disabilities Education Act (IDEA), and the Code of Maryland Regulations (COMAR). These laws and regulations ensure equitable access to educational programs, effective communication, accessible services, and opportunities for students with disabilities to achieve meaningful academic, functional, and behavioral outcomes.

Want to share your program or event with ACPS families? Complete the ACPS Distribution of Materials Form to request approval. Once approved, your flyer will be distributed electronically through our digital flyer system (our preferred method) or, if appropriate, you'll receive instructions and permission to deliver printed copies to schools in stacks of 25.
After submitting the form, you'll receive a response from Christian Brooks, Coordinator of Special Projects, with the status of your request and any next steps.

Maryland Public Information Act Request
The Board of Education of Allegany County ensures that Allegany County Public Schools complies with the Maryland Public Information Act, Annotated Code of Maryland, General Provisions Article Sections 4-101 through 4-601 when responding to requests for public information and to outline procedures for filing such requests with the school system.
Anyone may request to inspect or obtain copies of public records of the school system, unless the requested records fall into one of the exceptions provided in the MPIA. To make a request for information under the Maryland Public Information Act, submit in writing to:

Under the law, the Allegany County Public School System must respond to requests within 10 business days if and only if the school system believes that it will take more than 10 business days to produce public records. OIG Hotline
The Office of Inspector General Fraud Reporting Hotline (OIG Hotline) is available for anyone who knows of or suspects fraud, waste, abuse, mismanagement, or violations of laws and regulations involving U.S. Department of Education funds or programs. This includes allegations of suspected wrongdoing by Department employees, contractors, grantees, schools and school officials, persons in positions of trust involving Department funds or programs, collection agencies, recipients of student financial assistance, or lending institutions.
Request for Proposals
The Allegany County Public School District seeks proposals from qualified sources to perform a detailed demographic and enrollment analysis projection for redistricting of elementary school attendance areas by means of a fixed price contract through a competitive sealed proposal process. The data gathered and analyzed will be used to determine staffing and attendance balance in the Allegany County Public School District to match the capacity of the facilities. Any award/contract will be pending the Board of Education of Allegany County approval and availability of funds.

Use of Facilities
The Board of Education encourages the use of public school facilities and makes its buildings and other properties available for community activities and events when they are not being used for their principal purpose.
The right to use the property for any lawful purpose is subject to approval by the Board of Education. Accordingly, the Superintendent shall establish detailed regulations, pertaining to the public use of all school facilities. Such regulations will address costs of operation, user fees, and liability issues.

Elementary Schools Facility Utilization Study
In November 2017, the school board contracted with Facility Engineering Associates (FEA)(opens in new tab) for consultant services for facility utilization and analysis of elementary schools in ACPS. FEA was charged with assessing the physical condition and educational adequacy of the schools as well as bus routing scenarios prior to giving a recommendation to the Blue Ribbon Commission, which was formed to serve as a resource to the school board to work collaboratively with FEA.
The Blue Ribbon Commission in ACPS consists of community leaders, including those outside of education, and provides FEA with relative and important information and perspectives regarding the task of adjusting attendance boundaries for more efficient and effective utilization of school capacity.
